SOLID WASTE
CHAPTER 13.
13-1. Purpose. The purpose of this Chapter is to provide for the sanitary
disposal and disposition of garbage and refuse, to eliminate unsanitary and
unsightly conditions, and to protect the health, safety and welfare of the city
of
13-2. Definitions. For use within this ordinance the following terms are defined:
a. "Refuse" includes all garbage, rubbish, ashes or other substances offensive to sight or smell, dangerous to the public health, or detrimental to the best interests of the community, except dead animals not killed for food.
b. "Garbage" includes all waste food matter or any other substances offensive to the sight and smell or dangerous to public health except dead animals not killed for food.
c. "Rubbish" includes all other refuse not falling within the term "garbage" except those objects too large to be placed in cans.
d. "Covered containers" shall include sealed garbage bags or disposable boxes or other closed metal or plastic containers which are of a size that may conveniently be handled by the Collector and not to exceed 75 pounds in weight.
e. "Person" includes any individual, firm, corporation, association, trust, and any other organized group or government.
f. "Collector"
shall mean the person contracting with the City for hauling to the dump site
all refuse, garbage and other solid waste, or the City of
13-3. Duty to Provide Containers. Each person shall provide containers for the storage of garbage and refuse accumulating on premises owned or occupied by him. Such containers shall be kept covered or closed and reasonably clean at all times and said containers shall be placed in a position accessible to the Collector outside of dwellings but not in alleys or streets except when temporarily placed in streets or alleys for immediate collection.
13-4. Accumulation and Deposit of Refuse Prohibited. No person shall permit refuse to accumulate upon premises owned or occupied by him unless in cans or approved bags. Nor shall he deposit waste materials upon any other premises. This section shall not apply to City sanctioned recycling programs.
13-5. Collection and Hauling. All garbage, rubbish and refuse must be taken from dwellings at least once each week and from business establishments as frequently as the Council may reasonably required.
All garbage, rubbish and refuse must be transported by the Collector in a covered vehicle or covered containers constructed to prevent spilling, draining, emission of offensive odors, or loss of materials during transit.
No person shall be a Collector or haul (for hire) any garbage, rubbish or refuse unless authorized by contract with the City Council.

13-8. Charges. Every occupied residence, business establishment, or dwelling unit in the City of Elberon, Iowa, shall be subject to a collection fee for collection and disposal of refuse in accordance with a schedule of charges established from time to time by resolution of the Elberon City Council, initially established herein at $2.00 per week.
13-9. Yard Waste - Definition.
a. Definitions. "Yard Waste" means organic debris (e.g. grass clippings, leaves, tree limbs, bark, branches, flowers, etc.) which is produced as part of yard and garden development and maintenance.
b. Separation of Yard Wastes Required. All yard wastes shall be separated by the owner or occupant from all other garbage and refuse accumulated on the premises and shall be composted on the premises, or otherwise legally disposed of.
13-10. Accounts. All accounts shall be billed for the same period of time that the water and sewer billing covers for that unit, and such account shall be due no later than the tenth day of the month following the mailing of such billing notice. If any user fails to pay the fee so billed when due, there shall be added a penalty of 10% of the amount billed, plus cost of certified mail.
