TRAFFIC CODE

 

                                                                  CHAPTER 12.

 

 

            12-1.  Title.  This Chapter may be known and cited as the Elberon Traffic Code. 

 

            12-2.  Speed Regulations. 

 

            1.         General.  Every driver of a motor vehicle on a street shall drive the same at a careful and prudent speed that is not greater nor less than as is reasonable and proper having due regard to the traffic, service and width of the street and of any other conditions then existing, and no persons shall drive a vehicle on any street at a speed greater then will permit him to bring it to a stop within the assured cleared distance ahead, such driver having the right to assume, however that all persons using said street will observe the law.

 

            12-3.  Excessive Acceleration. 

 

                        It shall be unlawful for any person in the operation of a motor vehicle, including motorcycles, to so accelerate such vehicle as to cause audible noise by the friction of the tires on the pavement or to cause the front wheel of the motorcycle to leave the ground more than 2 inches, except when such acceleration is reasonably necessary to avoid a collision.

 

            12-4.  Special Speed Districts.

 

            1.         Business District.  No motor vehicle shall exceed a speed of 20 miles per hour in the business district, unless specifically designated otherwise in this chapter.

 

            2.         Residence or School District.  A speed in excess of 25 miles per hour in any school or residence district, unless specifically designated otherwise in this chapter, is unlawful.

 

            3.         Emergency Vehicles.  The speeds and limitations set forth in this chapter do not apply to authorized emergency vehicles when responding to emergency calls and the driver thereof sounds audible signal by bell, siren or whistle.  This provision does not relieve such driver from the duty to drive with due regard to the safety of others. 

 

 

            4.         Special Speed Restrictions.  Whenever the City Council shall determine upon the basis of historical experience or engineering and traffic investigation at any speed limit herein set forth is greater or less then is reasonable or safe under the conditions found to exist, the City Council may adopt by ordinance, higher or lower speed limits as deems reasonable and safe.  In accordance therewith the following special speed restrictions are established:

 

                        a.         Fifth Avenue from the south City limits to the north City limits shall have a maximum speed limit of 25 miles per hour, and traveling in excess of that speed is unlawful.

 

            12-5.  Load Limitations.  There is hereby imposed upon all city streets a maximum load limitations for all wheeled or track vehicles using the city streets of 12 tons, gross vehicle weight.  This restriction shall not apply to the following streets or roadways:

 

            1.         County Road E-44. 

 

            2.         Railway Street.

 

            3.         Fifth Avenue.
